TERMS AND CONDITIONS FOR RB AQUATIC WHOLESALE LTD
- DEFINITIONS:
- "Customer" refers to the individual or business purchasing goods from RB Aquatic Wholesale LTD.
- "Company" refers to RB Aquatic Wholesale LTD.
- "Goods" refer to live tropical and cold-water fish and related products supplied by the Company.
- BASIS OF CONTRACT:
- These terms and conditions form the entire agreement between the Company and the Customer and supersede any previous agreements or communications.
- ORDERS:
- Orders are accepted via email or through the Company's official ordering system. A minimum order value of £50 applies.
- Acceptance of the order will be confirmed in writing by the Company.
- PRICING:
- Prices are quoted exclusive of VAT unless stated otherwise and are subject to change without prior notice. Any changes will not affect orders already confirmed.
- PAYMENT TERMS:
- Payment must be made in full within 7 days of the invoice date, unless otherwise agreed in writing by RB Aquatic Wholesale LTD.
- Accepted payment methods include [e.g., bank transfer, credit card, PayPal]. Bank transfer details will be provided on the invoice.
- Late payments will incur an interest charge of 5% per month, calculated daily from the due date until the outstanding amount is paid in full.
- The Company reserves the right to suspend or cancel future orders if there are outstanding payments beyond the agreed terms.
- DELIVERY:
- The Company will deliver live fish to the Customer's specified location using two delivery methods:
- Overnight Courier Deliveries: Orders will be delivered on the next working day following dispatch.
- Own Van Deliveries: Orders will be delivered on a specified day, as agreed upon with the Customer during order confirmation.
- Risk transfers to the Customer upon delivery. The Company is not liable for delays due to circumstances beyond its control.
- QUALITY AND RETURNS:
- All live fish are inspected before dispatch to ensure quality. Any issues with the goods must be reported within 2 hours of delivery.
- Claims for defects or mis-deliveries must include clear photographic evidence showing the condition of the goods upon arrival. This evidence must be submitted via email or the Company's designated communication channel.
- Returns are not accepted for live animals unless agreed upon due to specific defects or mis-deliveries supported by photographic evidence.
- LIABILITY:
- The Company’s liability is limited to the replacement of defective goods or refund of their value. The Company will not be liable for any indirect or consequential loss.
- FORCE MAJEURE:
- The Company is not responsible for delays or failure to perform obligations due to events beyond its reasonable control, including natural disasters or transportation disruptions.
- GOVERNING LAW:
- These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- DATA PROTECTION:
- The Company complies with GDPR and will only process the Customer's personal data for order fulfilment and communication.
- AMENDMENTS:
- The Company reserves the right to amend these terms and conditions at any time. Updated terms will be communicated to the Customer in writing.
